Itemtify Terms of Service
This is an unofficial English translation provided for convenience. In the event of any discrepancy between this translation and the Korean original, the Korean version prevails.
Effective Date: July 22, 2026
Article 1 (Purpose)
These Terms govern the rights, obligations, and responsibilities of the Operator and Members, and other necessary matters, in connection with the use of the mobile application "Itemtify" (the "Service") provided by Cubed (representative: Ruan) (the "Operator").
Article 2 (Definitions)
- "Service" means the mobile application Itemtify, which allows users to photograph real-world objects, collect them as background-removed digital items, place them in a virtual space, and trade them using virtual currency.
- "Member" means a person who agrees to these Terms, creates an account, and uses the Service.
- "Item" means digital content created within the Service based on a photograph taken by a Member.
- "Gold" means virtual currency that can be used only within the Service.
- "Appraisal" means the feature by which the Service assigns a grade, name, description, and the like to an Item.
- "Auction" means the in-Service feature by which Members transfer the holding rights to an Item in exchange for Gold.
- "Room" means a virtual space within the Service in which Items are held, placed, and displayed.
- "Shared Room" means a state in which a Member invites other Members to connect their Rooms; the connected Members are the "Participants."
- "Nickname" means a Member's display name, generated from a combination of words provided by the Service and shown to other Members.
Article 3 (Effect and Amendment of the Terms)
- These Terms take effect by being posted on the Service screen or announced by other means.
- The Operator may amend these Terms within the scope that does not violate applicable laws.
- When amending the Terms, the Operator will announce the effective date and the reasons for the amendment from 7 days before the effective date. For amendments unfavorable to Members, the announcement will be made from 30 days before, with individual notice by email or other means.
- If a Member continues to use the Service after the effective date of the amended Terms, the Member is deemed to have agreed to them. A Member who does not agree may terminate the use agreement (withdraw membership).
Article 4 (Membership Registration and Account)
- Membership registration is carried out through linking a Google account or an Apple account. No separate ID or password is created; registration and login are not distinguished.
- Persons under 14 years of age may not register as Members.
- A Member is responsible for securely managing the linked external account and may not transfer or lend the account to any third party.
- A Nickname is automatically generated upon registration, and a Member may re-draw the Nickname up to the number of times determined by the Service. The Nickname is displayed to other Members.
- The Operator may refuse registration or subsequently terminate the use agreement in any of the following cases:
- Where another person's information has been misappropriated
- Where there is a prior record of use restrictions due to a violation of these Terms
- Where registration was made for any other improper purpose
Article 5 (Contents of the Service)
- The Service provides the following features:
- Creating Items by removing the background from photographs of objects taken with the in-app camera
- A physics-based virtual space for placing and organizing Items in Rooms, Room decoration, and wallpaper image creation
- AI-based Appraisal of Items (assigning grade, name, and description)
- Gold-based Item auctions among Members
- Writing and viewing comments on Items
- Displaying Items with other Members through Room sharing and sharing invitation links
- Gold rewards based on attendance, daily missions, achievement goals, and the like
- Earning Gold and using the Appraisal feature by watching rewarded advertisements
- Ranking display based on a Member's holdings
- Push notifications for in-Service events
- The Service is, in principle, provided year-round, but may be temporarily suspended due to system maintenance, failures, circumstances of external partner services, and the like.
- The detailed figures for each feature (reward amounts, fees, usage-count limits, Room capacity, etc.) are displayed within the Service, and the Operator may change them as necessary for Service operation.
Article 6 (Gold)
- Gold is virtual currency granted free of charge by methods determined by the Service, such as registration rewards, attendance and mission rewards, advertising-viewing rewards, and Item sale proceeds.
- Gold cannot be purchased with cash and cannot be exchanged or refunded for cash or any property benefit. Exchanging Gold for cash or other real-world consideration is prohibited.
- Gold is used for purposes determined by the Service, such as requesting Appraisals, registering auctions, and bidding, and is deducted at that time.
- The criteria and amounts for granting and deducting Gold are displayed within the Service, and the Operator may change them as necessary for Service operation.
- Records of Gold grants and deductions are preserved as append-only records to prevent forgery or alteration.
- The Operator does not sell Gold for a fee. Products provided through paid payment are governed by Article 6-2.
- Upon withdrawal of membership, held Gold is extinguished and cannot be restored.
Article 6-2 (Paid Products)
- The Operator sells paid products that expand in-Service usage space (such as adding a Room or adding a Bag) through in-app purchases on the Apple App Store or Google Play. What is sold is usage space; Gold is not sold.
- The type, price, and contents of paid products are displayed within the Service and on each store, and actual payment is made through the payment methods provided by Apple and Google.
- A paid product is granted to the Member's account after payment is confirmed, and once granted, the product belongs permanently to the account (it is not a consumable product). Upon withdrawal, it is extinguished pursuant to Article 17.
- Withdrawal of subscription and refunds: Under the Act on the Consumer Protection in Electronic Commerce, a Member may withdraw the subscription within 7 days from the date of payment. However, the withdrawal of subscription may be restricted for products already granted and used, or in other cases prescribed by law.
- Refunds follow the refund policy and procedures of the store where payment was made (Apple or Google). Inquiries regarding payment and refunds may be directed to the relevant store or to the contact in Article 20.
- If a Member does not receive a product for a legitimate reason after payment, the Operator will verify the payment record and take measures to grant the product or process a refund.
Article 6-3 (Friend Referral)
- A Member may invite others to the Service using the referral code or referral link provided by the Service, and there is no limit on the number of people invited.
- A person who receives an invitation may designate a referrer only once, within the period set by the Service after registering. The designation cannot be changed thereafter, and a Member may not use their own referral code.
- Referral rewards are paid to both the inviting Member and the invited Member at the point when the invited Member actually completes the basic use of the Service (creating and appraising an Item). Registration alone does not result in payment.
- The Operator may set a daily payment limit to prevent fraudulent use. Rewards exceeding the limit are not forfeited and are paid out sequentially thereafter.
- The amount, payment conditions, period, and limits of rewards are displayed within the Service, and the Operator may change them or discontinue the feature as necessary for Service operation.
- When the referral feature is used, the Nicknames of the inviting Member and the invited Member are shown to each other, and the Nickname of the inviting Member is shown to the person who receives the referral link.
- Measures under Article 16 may be taken with respect to referral rewards obtained in violation of Article 15.
Article 7 (Items and Content)
- The copyright in photographs taken by a Member belongs to the Member. The Member permits the Operator to use such photographs and Items to the extent necessary to provide the Service (Item creation, storage, display, Appraisal, auction posting, Shared Room display, etc.).
- A Member may not create Items with photographs falling under any of the following:
- Photographs infringing the intellectual property rights of others, such as copyrighted works or trademarks
- Photographs infringing the portrait rights or privacy of others, such as another person's face
- Photographs contrary to laws or public order and morals, such as obscene material, hateful or discriminatory expression, or cruel expression
- Photographs of something that is not a real object, such as a screen or printed matter (subject to the fake determination under Article 8)
- An Item is digital content that exists only within the Service; "holding" an Item means only the right to use it within the Service and does not mean ownership of the original photograph or any legal right in rem.
- Deleting an Item deletes the related records (engravings, appraisals, personal content) together, and they cannot be restored. However, the transfer history of transactions already made is preserved pursuant to Article 9(3).
- The Operator may delete or make private, without prior notice, any Item that violates Paragraph 2.
Article 8 (AI Appraisal)
- Appraisal is an entertainment feature performed by artificial intelligence and probability-based algorithms, and its results (grade, name, description, figures, etc.) do not guarantee the objective value or authenticity of the actual Item.
- Appraisal may be requested by paying Gold or by watching a rewarded advertisement.
- Appraisal is possible only once per Item, and the result does not change. Re-appraisal is not provided.
- A Member may select the character to conduct the Appraisal, and the probability by which the grade is determined and the manner of naming differ by character. Each probability can be checked within the Service.
- An Item determined to be a photograph of something that is not a real object (such as a screen or printed matter) may be given the lowest grade.
- A photograph determined to be inappropriate for Appraisal, such as hateful, cruel, or sexually explicit expression, will be refused Appraisal, and a mark indicating that further Appraisal cannot be requested will permanently remain on that Item. In this case, Gold already paid will not be refunded, as processing costs have been incurred (where the request was made by watching an advertisement, no Gold is deducted).
- Due to the nature of AI determinations, there may be misjudgments in the determinations under Paragraphs 5 and 6, and because there is no re-appraisal, it is notified before requesting Appraisal that such results also do not change.
- The Operator may limit the number of Appraisal requests to ensure Service stability and manage costs.
Article 9 (Auction)
- A Member may register an appraised Item of the Member's own in an auction, and other Members may bid with Gold or make an instant purchase.
- A registration fee is deducted upon auction registration and is not refunded even if the registration is canceled. This is to prevent exposure spamming through repeated registration and cancellation.
- Upon bidding, the corresponding Gold is immediately deducted (held) and is returned when a higher bid appears. After a bid has been made, the auction cannot be canceled.
- The auction is automatically settled by the server at the closing time. Upon a successful bid, the holding rights to the Item are transferred to the winning bidder, and Gold is paid to the seller. All transfer histories are preserved as records for Service integrity, and the previous holder can be checked in the Item details.
- An Item registered in an auction is disclosed to other Members, and the seller's Nickname and profile image, Item information, view count, and comments are displayed together.
- A completed winning transaction is not canceled or refunded. However, the Operator may restore erroneous transactions caused by system errors.
- Fraudulent transactions using auctions (abuse through wash trading, linkage with cash transactions, etc.) are prohibited.
Article 10 (Room Sharing)
- A Member may connect the Member's Room with other Members so that they can view each other's Items, and may invite Participants through an invitation code or invitation link.
- Items placed in a Shared Room and the Members' Nicknames and profile images are disclosed to all Participants of that Shared Room. A Member is responsible for verifying, on their own, with whom and what content is shared.
- A Participant may only view other Participants' Items and may not modify, delete, or transfer them.
- The capacity of a Shared Room is used together by all Participants, and its figure is displayed within the Service.
- A Member may stop sharing or leave the Shared Room at any time. When sharing is stopped, the relevant Item is no longer displayed to other Participants.
- The Operator is not responsible for posting an invitation link in a public place so that an unspecified number of people participate, and may stop such sharing if necessary.
Article 11 (Comments and Interaction Among Members)
- A Member may write comments on Items. Because comments belong to the Item, they continue to be displayed even if the Item is transferred to another Member or re-registered in an auction.
- Comments are disclosed to other Members, and the author's Nickname and profile image are displayed together.
- Comments may not contain content equivalent to Article 7(2), slander, abuse, or discriminatory expression against others, or advertising or promotional content.
- A comment may be deleted by the author or the current holder of the relevant Item. A deleted comment is not displayed on the screen.
- The Operator may limit the length of comments and the interval between comments to prevent spamming, and may delete comments that violate Paragraph 3 without prior notice.
Article 11-2 (Reporting and Blocking)
- Where a Member determines that another Member's comment or Item violates these Terms, the Member may report it through the in-Service feature. A report is received immediately without selecting a reason, and the Operator reviews the received content and takes necessary measures such as deletion, non-disclosure, or use restriction.
- A Member may block another Member. Blocking causes that Member's comments and auctions not to be displayed on the blocking Member's screen.
- Blocking applies in one direction only and is not notified to the blocked Member. Blocking is not a sanction against the other party but a setting to hide them from your screen.
- Blocking can be released at any time in the in-Service settings.
- Repeatedly making false reports or abusing the reporting feature may be subject to use restrictions under Article 16.
Article 12 (Ranking and Disclosed Information)
- The Service may calculate and display rankings based on a Member's holdings (the sum of Gold, the appraised value of held Items, and the amount held in ongoing bids).
- While the ranking feature is provided, a Member's Nickname, size of holdings, and ranking are disclosed to other Members.
- The method of calculating holdings is displayed within the Service, and the Operator may change it or discontinue the ranking feature as necessary for Service operation.
Article 13 (Notifications)
- The Service may send push notifications to a Member's device regarding in-Service events such as auction wins and bids, Room sharing, comments, and reward acquisition.
- A Member may change whether to receive each type of notification at any time in the in-Service settings, and may block all notifications in the device's operating system settings.
- A device registration token is collected and used to send notifications, and matters concerning this follow the Privacy Policy.
Article 14 (Advertising)
- The Service may include advertisements, and a Member may watch rewarded advertisements and receive Gold or the right to use the Appraisal feature.
- The type and quantity of advertising-viewing rewards and the daily usage count are displayed within the Service and may change as necessary for operation.
- Advertising-viewing rewards are granted only where the advertising provider has confirmed to the Operator that viewing was completed. If confirmation is delayed due to communication conditions or the like, reward payment may also be delayed.
- The processing of personal information in the course of providing advertisements follows the Privacy Policy.
Article 15 (Prohibited Conduct)
A Member may not engage in any of the following conduct:
- Misappropriating another person's account or information
- Using the Service with automated programs (macros, scripts, etc.) or making abnormally large volumes of requests
- Reverse-engineering, altering, or hacking the Service's server or client, or exploiting vulnerabilities
- Acquiring or attempting to acquire advertising-viewing rewards, attendance and mission rewards, friend referral rewards, and the like by improper means (including obtaining referral rewards by creating multiple accounts oneself or by using another person's account)
- Trading Gold or Items for cash or other real-world consideration
- Creating or posting content falling under Article 7(2) or Article 11(3)
- Any other conduct that violates laws or interferes with the normal operation of the Service
Article 16 (Use Restrictions and Recovery of Improperly Obtained Assets)
- The Operator may take measures such as a warning, temporary suspension of use, or permanent suspension of use where a Member violates these Terms.
- The Operator may recover or extinguish in-Service assets such as Gold and Items obtained in violation of Article 15, and may withhold or cancel rewards not yet granted. Because records of Gold grants and deductions are never deleted, recovery is carried out by adding a record that deducts the corresponding amount.
- Where a measure under Paragraph 1 or 2 is taken, the Member is notified of the reason (for Paragraph 2, including the assets and amounts recovered) and the period. A Member with an objection may raise it at the contact in Article 20.
Article 17 (Termination of Agreement and Withdrawal)
- A Member may terminate the use agreement at any time through the in-Service withdrawal feature or the contact in Article 20.
- Upon withdrawal, the Member's personal information is destroyed in accordance with the Privacy Policy, and held Gold and Items are extinguished.
- Information necessary to maintain Service integrity, such as transaction records, is converted into a form in which the individual cannot be identified and preserved. This is to ensure that the transfer history of Items held by other Members is not broken.
- Withdrawal is not possible while there is an ongoing sale auction or while being the highest bidder. Withdrawal is possible after the relevant auction ends.
Article 18 (Change and Termination of the Service)
- The Operator may change or terminate all or part of the Service, and upon termination will notify by in-Service announcement and email at least 30 days in advance.
- For the change or termination of services provided free of charge (including Gold), the Operator does not separately compensate unless there is a special provision in applicable laws.
Article 19 (Disclaimer)
- The Operator is not responsible for Service interruptions due to natural disasters, failures of third parties such as telecommunications carriers or cloud providers, or other force majeure.
- The Operator has no obligation to intervene in disputes arising through the Service between Members or between a Member and a third party, and is not responsible in the absence of intent or gross negligence.
- The Operator is not responsible for the legality or accuracy of content posted by Members on the Service (Items, comments, content displayed in Shared Rooms, etc.). However, upon becoming aware of illegal content, the Operator takes measures without delay.
Article 20 (Dispute Resolution and Jurisdiction)
- Inquiries, complaints, and disputes related to the use of the Service may be received at the contact below, and the Operator will endeavor to handle them promptly.
- Email: ruan@cubed.im
- These Terms are interpreted in accordance with the laws of the Republic of Korea, and any lawsuit regarding disputes arising in connection with the use of the Service shall be filed with the competent court under the Civil Procedure Act.
